The fire insurance is the basis of a comprehensive home insurance policy. Historically, this is the first risk insured by a company in AMERİCA. Thus, the first fire company was founded in 1754 and the first royal fire insurance company was created in 1785.
In the Insurance Code, the rules and limits of fire insurance are defined by Articles L122-1 to L122-8.
What events are insured?
Article L 122-1 defines fire by "conflagration, conflagration or simple combustion". In general, insurance companies regard fire as "burning with flames outside of a normal home".
This definition obviously excludes the fires contained in chimneys, stoves and other barbecues. Examples of exclusions: broken ice near an oil stove, falling an object in a chimney ...
In a traditional contract, the following events, equated with fire, are also covered:
Smoke without fire, for example due to malfunction of a heater or other appliance.
See our dedicated article: Smoke Detector and Home Insurance: What Obligations?
The fall of lightning on the insured buildings. This warranty excludes damage to electrical appliances that remain plugged in, and a specific option must be purchased. Explosion and implosion, whether they occur inside or outside the dwelling.
According to the formulas and options:
The action of heat without fire.
What are the insured losses?
The insurer covers all damage caused by a fire, whether the fire began inside or outside the dwelling. Physical damage due to relief and emergency measures are also covered.
The loss or disappearance of insured items occurring during the fire is covered, unless the loss is due to theft.
Depending on the options and formulas of the contract, the following indirect damages can also be assured:
Expert fees: to defend against the expert mandated by the insurer.
Deprivation of use: the accommodation costs for the occupant, the rental value for the non-occupant owner. One year limited warranty.
Indirect losses: the non-quantifiable expenses incurred by the insured.
Costs of excavation and demolition.
What are the insured assets?
The insured property is:
All furniture in the dwelling at the time of the fire.
Valuables and jewelery, within the limits of the amount you choose when you take out the contract (attention to the definition of the object of value, it is changing according to the insurers).
The building itself.
Attention: the amount reimbursed on these goods will take into account the age.
Third party liability
To the above damages is added a guarantee of civil liability, covering the damages caused to others. This guarantee varies according to the quality of the insured:
Tenants and occupants free of charge: vis-à-vis the owner and neighbors.
Homeowners: vis-à-vis neighbors.
Non-occupying owners: vis-à-vis tenants in the event of construction defects or lack of maintenance, vis-à-vis neighbors.
The measures to be followed for a good application of the guarantee
Annual chimney sweeping of your chimneys, boilers, wood stoves and inserts. This sweeping must be carried out by a professional who must issue a certificate to be presented to the insurer in the event of a disaster.
See our dedicated article: Chimney sweeping and home insurance: what obligations?
The installation of a chimney insert (closed hearth) must be carried out by a professional.
Regular brushing of the ground (Article L 122.8 of the Insurance Code).
If the following steps are not followed, you may be subject to an additional deductible on the amount of compensation. This point should be checked on the general conditions of the home insurance contract.
Beware of warranty exclusions for smokers
The burns caused by the smokers (on a piece of furniture, a carpet ...) are not covered. Damage caused by the explosion of dynamite or other explosives held inside or outside the dwelling will also not be covered.
